In a landmark ruling by President Judge Cohn Jubelirer, The Commonwealth Court of Pennsylvania ventured into uncharted territory and held that education is a fundamental right in Pennsylvania and that the current funding structure of Pennsylvania’s public schools violates the Equal Protection Clause of the Pennsylvania Constitution. Six school districts, along with several parents and their children and two organizations, brought this action in the original jurisdiction of the Commonwealth Court of Pennsylvania nearly a decade ago. The ruling now solidifies what the Court states have been a clear end goal of the Commonwealth’s forebearers: “to provide as many children as possible with an education that would allow them to participate as meaningful and productive members of society.” William Penn Sch. Dist. v. Pennsylvania Dept. of Educ., No. 587 M.D. 2014 at 16, (Pa. Cmwlth. Ct. Feb. 7, 2023). The Court’s Opinion traces over 200 years of state history with a detailed look at the Pennsylvania Constitution. This proposal will review the evolution of the Pennsylvania Education Clause and the meaning of a “thorough and efficient system of public education” PA. CONST. art. III §14.
