“Never Forget, Never Again:” Using the Law to Fight Anti-Semitism in Public Schools

Over the past several years, American public schools and universities have seen an aggressive resurgence of anti-semitism, manifesting itself in everything from curriculum fights to harassment to outright Holocaust denial. According to a 2022 survey conducted by the Jewish Community Relations Bureau in Overland Park, Kansas, 89% of Jewish students in the great Kansas City area asserted that they had experienced or witnessed at least one form of anti-semitism either at school (81% of all students) or on social media (70% of all students). In addition, only 25% of Jewish students surveyed said anti-semitism was “not a problem at all” in their school. Such hostility, both in Missouri and other parts of the country, has predictably resulted in a variety of legal claims against public schools and colleges, as Jewish students have sought relief from agencies and courts. This session will provide an overview of some of the most egregious incidents and patterns of anti-semitism in American public schools, and explore the various legal strategies that both Jewish students, as well as education officials and attorneys, could utilize to effectively address the resurgence of anti-Jewish aggression. Specifically, this session will focus on three distinct legal tools that must be considered as part of the efforts of schools and colleges to root out anti-semitism and hold perpetrators accountable: 1) Title VI of the Civil Rights Act of 1964; 2) interpretations of the First Amendment that preserve students’ “right to read” or “right to knowledge” (e.g, Island Trees School District v. Pico, etc.); and 3) a little known concept known as “group libel,” that was upheld in 1952 by the U.S. Supreme Court in Beauharnais v. Illinois.
