This research examined translator use in special education due process hearings. Of specific interest was the question, what is the probability of fully or partially prevailing in due process hearings in cases that involved the use of a translator, counsel representation/no representation, student was the plaintiff, and the district’s free/reduced priced meal (FRPM) rate? An OLS regression (n = 845) of the binary dependent variable “student received anything” (student prevailed, there was a split decision, versus district or no party prevailed) on indicators for translator, lawyer representation and student plaintiff, as well as the enrollment and the percent of the district qualifying for FRPMs found that needing a translator was associated with a decrease in the likelihood of the student obtaining any favorable outcome in cases which reached a decision. This research provides new knowledge of the longitudinal distribution of a state’s hearing landscape by systematically integrating the district and individual family wealth indicators in the analysis.
