This Concurrent Session Paper and presentation will discuss recent federal court employment and labor law decisions involving educators—primarily teachers—in K-12 schools. The Paper and presentation will address the holding of and trends emanating from those judicial decisions as they interpret and apply federal antidiscrimination statutes, including Title VII, the Americans with Disabilities Act and Section 504 of the Rehabilitation Act, the Age Discrimination in Employment Act and the Family and Medical Leave Act, as well as federal retaliation provisions, including follow on retaliation provisions under the above-mentioned federal statutes and under the First Amendment. The paper and presentation will provide valuable legal-doctrinal information to both law and education professors and to school attorneys and teacher advocates. They will also provide practical and strategic advice to members of those same cohorts, as well to their respective clients.
