This study examines the changes impacting affirmative action including those in the areas of higher education, school districts and charter schools, and employment. Affirmative action constitutes a voluntary preference plan for hiring or selecting individuals in response to a statistical disparity in representation of people of specific races or genders including past discrimination. Challenges to these practices often are made using the Fourteenth Amendment, Title VI, Title VII or Title IX.
